Flying With Weed

Flying with weed is legal in South Africa

If you’re gearing up for a lekker local getaway, like maybe a sneaky weekend in Joburg, a sun-chasing escape to Durban, or a Cape Town chill-and-thrill, flying with weed might be something you’re considering.

But before you head off into the airport with a “puff-puff above the clouds energy”, you do need to make it through the airport obstacle course.

While domestic airport security in South Africa isn’t like the international-style “take off your shoes, belt, dignity” experience, but nobody wants a police officer eyeing their homegrown stash, and absolutely nobody wants to be explaining sativa vs indica to a sniffer dog with strong career ambitions.

Before you decide on exercising your newfound rights, laid out in the Cannabis for Private Purposes Act (2024), the skies are still not a blazing free-for-all.

Airports fall under national security, which means your weed is still technically illegal over a certain amount.

But here’s the good news: the kind you came for:

People fly domestically with small, personal-use amounts all the time without hassle… if they keep it low-key, legal-ish, and sensible.

So, is it 100% legal to carry weed on board?

It’s not an offence to carry small personal-use cannabis on domestic flights, according to updated police directives.

Carrying small amounts of cannabis for personal use won’t lead to criminal charges. However, this is only applicable as long as the quantity aligns with what the courts consider “personal consumption.”

But (and there’s always a but) a few critical conditions still apply when flying with weed:

  • The amount must clearly fall within personal-use limits, not distribution or dealing territory.
  • It needs to be discreetly stored and properly sealed. No flashing your buds in the security queue, and definitely no letting your bag smell like a hotboxed Uber. A scent-proof, airtight pouch is your best friend.
  • Public consumption is still banned under the Act, meaning no lighting up in the airport, bathrooms, on the plane, or anywhere outside a private space.

Keep it small, sealed, and private. You’ll get to your destination with your stash (and your chill) entirely intact.

Here’s the lowdown, straight from the police directive:

Passengers flying on a commercial airliner with small amounts of cannabis:

“Provided that the quantity of cannabis is small and based on all the circumstances of a specific matter, including the concealment of the cannabis in a bag or luggage of a passenger, possession for personal consumption, by an adult passenger on a domestic flight, is permitted.”

Heads-up: we don’t yet have a legal definition of what constitutes a “small” amount. That means it’s left up to an officer’s discretion.

Be smart and don’t stuff a giant stash in your tog bag..

And one more thing: this freedom applies only to domestic flights within South Africa. Once you try to fly overseas with weed, you’re stepping into a whole different level of risk.

Cannabis and International Travel: Absolutely Not Allowed

If you’re flying outside South Africa, don’t even think about carrying cannabis in any form.

Under the Drugs and Drug Trafficking Act, taking cannabis across the border, even a tiny amount, counts as drug dealing. That’s a serious criminal offence, and the police won’t be cool about it.

For those looking for a bit of good news, there is some movement locally to clear criminal records for minor cannabis possession, giving many South Africans a fresh start.

However, there is still some confusion around clearing criminal records, as many South Africans are still being prosecuted for cannabis possession.

We’d strongly suggest following NGOs such as Fields of Green for All for updates.
